The National Intelligence Grid (Natgrid) Project of India is an intelligence related project of Indian government. Other intelligence and e-surveillance related projects and initiatives of India include National Counter Terrorism Centre (NCTC) of India, Aadhaar Project of India, Crime and Criminal Tracking Network and Systems (CCTNS) Project of India, Central Monitoring System (CMS) Project of India, Internet Spy System Network and Traffic Analysis System (NETRA) of India, etc.
Intelligence related projects and activities in India are in bad shape and need urgent scrutiny of Indian Parliament and intelligence reforms. They also need transparency and strengthening to adapt as per contemporary requirements. Indian government and intelligence agencies are using secret wires in the telecom infrastructure to indulge in illegal and unconstitutional e-surveillance. Instead of ensuring transparency and accountability, intelligence agencies of India are demanding legal immunity against cyber deterrent acts.
E-surveillance projects of India need Parliamentary oversight and judicial scrutiny. Similarly, an e-surveillance policy of India (PDF) is need of the hour. Suitable laws must be formulated to regulate the work of intelligence agencies of India that are presently missing. A 10 points legal framework (PDF) for law enforcement and intelligence agencies of India has been provided by Perry4Law Organisation in 2009.
India must reconcile civil liberties and national security requirements while implementing e-surveillance related projects. Special stress must be given to privacy protection in general and civil liberties protection in cyberspace in particular. Otherwise, various stakeholders may impede the intelligence related activities of projects like Natgrid. For instance, recently banks in India refused to give direct access to Natgrid to their data base and customers details. These issues would increase in future unless there is a techno legal implementation for Natgrid project of India.
